1. Introduction

Welcome to the website of 4 Wheels Adventures (hereinafter “4WA”, “we”, “us”, “our” or “the Website”), available at www.4wheeladventures.com.hr.

These Terms of Use (“Terms”) govern your access to and use of the Website and of any services, tours, rentals, gift vouchers, or other products (collectively, the “Services”) offered by 4WA, whether booked online, by e‑mail, telephone, or on‑site.

By accessing or using our Website and/or Services you acknowledge that you have read, understood, and agree to be bound by these Terms and by any additional written policies referenced herein (such as our Privacy Policy, Safety Rules, and Cancellation Policy). If you do not agree with any part of these Terms, please refrain from using the Website or booking our Services.

Important! Off‑road driving and open‑air activities carry inherent risks. By participating you accept these risks and are responsible for your own safety within the limits set out below.

2. Eligibility

1. You must be at least 18 years old to book or pay for any Service. 2. Minors (under 18) may participate only if accompanied on site by a parent or legal guardian who signs our parental consent form. 3. It is strictly forbidden for passengers younger than 12 years to ride in the vehicles. 4. All drivers must hold a valid category B (car) driver’s licence and present it before departure. 5. Participation is not permitted if you are under the influence of alcohol, drugs, or any substance that could impair your abilities. 4WA staff may deny access or remove you from an activity without refund if impairment is suspected.

3. Booking & Payment

• Reservations are confirmed only after we have received (i) a completed booking form and (ii) full payment or an agreed deposit. We accept major credit cards, bank transfers, and cash (EUR/HRK) on site.
• Prices are stated in euros (EUR) and include VAT unless expressly stated otherwise.
• Group bookings, corporate events, and customised tours may be subject to separate written agreements.
  

3.1 Gift vouchers

Gift vouchers are valid for 12 months from the date of purchase unless a different validity period is printed on the voucher. Vouchers are non‑refundable but may be transferred to another person with our prior written consent.

4. Cancellations & Refunds

• Cancellations must be submitted in writing (e‑mail is sufficient) and are effective upon receipt.
• We reserve the right to cancel or modify an activity due to adverse weather, operational issues, safety concerns, or force majeure. You will be offered an alternative date or a full refund—our liability ends there.

5. Rules of Conduct & Safety

1. Zero‑tolerance policy: no alcohol or drugs before or during the ride. 
2. Operate vehicles only as instructed. Reckless driving, overtaking, drifting, or endangering others leads to immediate disqualification without refund. 
3. Obey the guide at all times. The guide’s decision is final on safety matters. 
4. Wear all protective gear provided (helmet, seat belt, goggles, etc.). Refusal = no ride. 
5. Respect nature and local communities. Do not litter, disturb wildlife, or leave marked tracks.

5.1 Damage & liability for costs

You are responsible for any intentional or negligent damage you cause to vehicles, equipment, or third‑party property. Damage will be assessed by 4WA staff and invoiced at actual repair or replacement cost. We may charge your credit card on file.

6. Assumption of Risk & Liability Waiver

• Off‑road driving involves bumps, dust, unpredictable terrain, and other hazards that can cause serious injury or death.
• By taking part you voluntarily assume all such risks.
• To the maximum extent permitted by Croatian law, you release and hold harmless 4WA, its owners, employees, and partners from any liability for injury, loss, or damage arising from your participation—except where caused by our wilful misconduct or gross negligence.
• Nothing in these Terms limits statutory consumer rights that cannot be waived.

7. Insurance

4WA maintains compulsory Croatian third‑party vehicle insurance. Personal accident, medical, and travel insurance are your own responsibility and strongly recommended.

8. Intellectual Property

All content on the Website—including text, photos, videos, graphics, trademarks, and logos—is the property of 4WA or its licensors. You may not copy, distribute, modify, or use any content without our prior written consent.

9. Privacy & Data Protection

We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and our separate Privacy Policy (available on the Website). By using our Services you consent to such processing.

10. User‑Generated Content

If you share photos, reviews, or other content with us (e.g. on social media), you grant 4WA a non‑exclusive, royalty‑free, worldwide licence to use, reproduce, and display that content for marketing purposes, unless you withdraw consent in writing.

11. Governing Law & Dispute Resolution

These Terms are governed by Croatian law. The competent court in Šibenik, Croatia has exclusive jurisdiction, unless consumer protection rules mandate another forum. Consumers within the EU may also submit disputes through the ODR platform (ec.europa.eu/consumers/odr).

12. Changes to the Terms

We may amend these Terms from time to time. Updated versions will be posted on this page with a new “Last updated” date. Continued use of the Website or Services after changes are posted constitutes acceptance of the revised Terms.
